General business conditions

of the stay in Wellness hotel Svornost in Harrachov.

1. Contractual relation

The mutual contractual relation between the stay participants (hereinafter referred as to "customer) and the keeper of Wellness hotel Svornost in Harrachov, company INGTOURS CK spol. s r.o. (hereinafter referred as "hotel") are governed by the regulations of Civic Code and Commercial Code and it is specified in these general conditions. The hotel reserves the right to introduce in its sales materials also other conditions and information which have priority over these conditions.

2. Prices and their changes

Orientation price of the stays and other service for citizicens of the Czech Republic are specified in the hotel presentation materials (websites www.hotelsvornost.cz, brochures, etc.). However the price binding for the customer is price given in the travel contract. In case of the additional increase of price of the stay the hotel is obliged to inform immediately in writing about the stay price change, within 14 days before departure at the latest. If this new price is higher than the price indicated in the travel contract by more than 10%, the customer is entitled to withdraw from the contract in writing and the entire amount for the stay will be returned to him without any unnecessary delay. If the customer does not withdraw from the contract within two days at the latest after he is informed about the price change, it is understood, that he agrees with a new price. The customer takes notice and agrees that when booking half of double bed (or possibly of a room with more beds), the surcharge must be calculated, the same as for a single room if another stay participant didn´t appear or if the customer didn´t ordered it specifically in the registration form.

3. Service, changes of services and prices agreed

The specification of services and their prices in the travel contract is binding for scope of services contractually agreed. Data in presentation materials have the informative character and have no influence on the object of the contract agreed between the customer and the hotel. Enlargement or changes of the services above the framework of the travel contract have to be confirmed in writing by the hotel and paid by the customer before the stay starts. The hotel is entitled to change the conditions of the stay in cases specified as "vis major" that cannot be influenced by him (unpredictable events or other circumstances). The hotel is entitled to inform the customer without any unnecessary delay about such changes, at the latest 10 days before the first service is provided. If the customer does not agree with these changes, he is entitled to withdraw from the contract without unnecessary delay. He will simultaneously receive back the entire amount paid for the stay. The customer is not entitled to seek any other compensation.

4. Cancellation of stay by the customer, change in reservation, alternatives

The customer is entitled to withdraw from the contract with the hotel anytime before the departure for the stay. Cancellation has to be done in writing. Time of notification receipt in writing by the hotel or by any of the contractual dealers of the hotel is decisive for cancellation time.

Cancellation fees are charged for each participants of the stay when it is cancelled:

31 and more days before the first service provision 10% from service price on order
30-21 days before the first service provision 30% from service price on order
20-14 days before the first service provision 40% from service price on order
13-07 before the first service provision 50% from service price on order
From 6th day before the first service provision 75% from service price on order
When the stay is not commenced or is cancelled after the first service provision 100% from service price on order
The minimum amount of cancellation fee is (always) 200, - CZK per each participant.

Groups (from 20 people) - the following cancellation fees are charged for each participant:

31 and more days before the first service provision 10% from service price on order
30-21 days before the first service provision 30% from service price on order
20-15 days before the first service provision 40% from service price on order
14-08 before the first service provision 60% from service price on order
From 7th day before the first service provision 100% from service price on order
The minimum amount of cancellation fee is (always) 200, - CZK per each participant.

When a change in wording of the travel contract is requested, which does not change the object of the contract agreed, such as e.g. change of client´ s name, type of services etc., the customer will pay the lump-sum fee 100,- CZK.

(Change of date is considered as the stay cancellation).

The hotel will not charge the customer the above mentioned cancellation fees if he could not use the services agreed from the reasons as follows: death in family, hospitalization of the customer or his/her family member, serious illness, call-up, a natural disaster. The customer is obliged to prove the above mentioned facts by a written document to the hotel within 3 days after they occur at the latest. If the customer withdraws from the contract due to the above mentioned reasons, he will be charged by the hotel only cancellation fee in amount of 10% from the service price on order and possibly the additional costs truly incurred.
Final settlement and returning of the amount paid by the customer, reduced by the cancellation fee will be done by the hotel within 30 days after the cancellation is notified at the latest.

5. Cancellation of stay by the hotel

The hotel is entitled to cancel the stay, if the stay realization is specifically made difficult or endangered or in case of vis major or emergency events, which could not be anticipated when the contract (binding registration order) was entered into. The hotel is obliged to inform the customer about stay cancellation without any unnecessary delay, however at the latest 10 days before the first service provision. In such a case the customer will receive money for services agreed immediately and without any unnecessary delay in full amount. The customer is simultaneously not entitled to seek any other compensation.

6. Complaints

The customer is obliged to inform the hotel immediately about his requirements and objection to quality of service provided. In case of complaint the customer is obliged to claim his requests in respect of a defect without any unnecessary delay directly in course of the stay so that they can be removed in place. If a complaint is not made immediately, the claim for compensation of damage incurred later is reduced or will expire, which could be avoided by laying a claim in time.

7. Insurance

Customers are not insured during their stay in the hotel.

8. Validity

These „General business conditions"of INGTOURS CK spol. s r. o. are valid for stay participants in hotel Svornost, no. 496, Harrachov and come into force on 1.10.2007 and become effective when they are signed by the customer.
